- Testimony—Expert witnesses must be skilled in relaying often complex information. The expert witness must have grounded his or her opinion in specialized knowledge +but must also be a master communicator—able to relay that specialized knowledge in a way that the average layperson (juror) can understand. Expert witnesses are, of course, stating an opinion, but it is an opinion with background information, scientific principles, and a building up of contextual understanding for jurors. When taken as a whole, the result of an expert witness’ testimony can be powerfully persuasive—therefore critically important.
- Research—Even though expert witnesses are experts in their field, they must still do research into what they will be speaking on. Every legal case is different, therefore, every expert witness will need to tailor his or her testimony to the case at hand. As an attorney providing expert witness services, that research goes the other way, as well. The worst scenario for an attorney in the midst of a case is to find out that the expert witness has issues in his or her past that could potentially discredit the testimony.
